The question of what rights a student surrenders when they enroll in a public school is one that has been debated and ruled upon many times. Schools must be allowed to use reasonable means to maintain order and a sound learning environment. Yet they must be prevented from trampling unnecessarily on the rights of pupils.

Into this environment of uncertainty comes the case of Thomas vs. the Public Schools. The case involves the rights of the student (Thomas) to have free and unfettered access to the Internet while at school. The student claims the access is needed to help prepare papers and complete homework assignments. The schools, however, say they must maintain some restrictions to prevent students from coming across obscene or inappropriate material during their online travels.

Previous cases in this area have upheld the rights of schools to limit student activity as necessary to protect the larger student population. Smith vs. New Orleans Schools affirmed the rights of schools to limit student smoking, while Gray vs. New York City Schools ruled that students could be limited in their school attire to protect public safety and maintain order. Given these precedents, this court sides with the defendant (Public Schools). The right of the school to limit Internet access is hereby affirmed.
